These Terms of Service (“Terms”) govern access to and use of (i) the Pixefy website and web application (the “Website”) and (ii) the Pixefy browser extension (the “Extension”) (together, the “Service”).

By downloading, installing, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1) Definitions
“Account”: a Pixefy account associated with an email address.
“Consumer”: a natural person acting outside their trade, business, craft, or profession.
“Extension”: Pixefy browser extension and related local components.
“Paid Plan”: any subscription or paid access tier offered by Pixefy.
“Service”: the Website and the Extension.
“User Content”: content you submit, upload, transmit, generate, store, or share using the Service (for example: annotations, screenshots you create, notes, settings, and any content you input into the Service).
“Third-Party Services”: services provided by third parties that may be used in connection with Pixefy (for example: authentication, payments, analytics, hosting, or other integrations).
2) Eligibility and authority
2.1 Eligibility. You must be legally capable of entering into these Terms.
2.2 Using on behalf of an organization. If you use the Service on behalf of a company or other entity, you represent that you have authority to bind that entity, and “you” includes that entity.
2.3 Consumer rights. If you are a Consumer, mandatory consumer protection laws may provide you with rights that cannot be waived or limited. Nothing in these Terms limits those mandatory rights.
3) Accounts
3.1 Account optional / required. Some parts of the Service may be available without an Account. An Account may be required for certain features (including Paid Plans).
3.2 Account security. You are responsible for keeping your Account information accurate and maintaining confidentiality of login credentials and access to your email account. You are responsible for all activity under your Account.
4) The Service
4.1 What Pixefy provides. Pixefy is a toolset for responsive previews and website testing across multiple device sizes and layouts. Features may include multi-pane previews, inspection tools, overlays, screenshot capture and annotations, and other productivity features.
4.2 Local display changes. Some features may modify how content is displayed locally in your browser (for example, overlays, previews, or visual adjustments) for testing and review purposes. Pixefy does not claim ownership over third-party websites you access through the Service.
4.3 No professional advice. Pixefy is provided for testing and productivity purposes. Any output or result from the Service may be incomplete or inaccurate depending on the website/environment. You are responsible for verifying results before relying on them in production or safety-critical contexts.
4.4 Availability. We may add, remove, or modify features at any time. We aim to keep the Service available, but we do not guarantee uninterrupted access.
5) Third-party websites and services
5.1 Third-party websites. You may use Pixefy to load, preview, and interact with third-party websites. Those websites are owned and controlled by third parties. Your use of third-party websites is subject to their terms and policies.
5.2 Third-Party Services. Some parts of Pixefy may rely on Third-Party Services (for example: authentication, payment processors, analytics, hosting). Pixefy does not control Third-Party Services and is not responsible for their availability, security, retention, or data handling practices.
6) Acceptable use
You agree not to (and not to allow others to):
a) use the Service in violation of law or regulation;
b) infringe or violate others’ rights (including IP, privacy, or publicity rights);
c) upload, share, or process unlawful, harmful, abusive, hateful, harassing, defamatory, or otherwise objectionable content;
d) attempt to gain unauthorized access to the Service or related systems;
e) interfere with or disrupt the Service (including bypassing access controls or rate limits);
f) reverse engineer, decompile, or disassemble the Service except where prohibited by applicable law;
g) use the Service to facilitate spam, phishing, fraud, malware, or other security threats;
h) share content you do not have the right to share, including confidential information or personal data you are not authorized to disclose.
We may suspend or terminate access where reasonably necessary to enforce these Terms, protect the Service/users/third parties, prevent abuse, or comply with law.
7) Free, Trial, Pro subscription, billing, delivery, and refunds
7.1 Free plan. Pixefy may offer a free plan (“Free”) with limited features. Free features and limits may change over time.
7.2 14-day Trial (card required). Pixefy may offer a 14-day Trial of Pro features. A valid payment method may be required to start the Trial. Trial availability, included features, and eligibility conditions may be described on the Website or in-product. Pixefy may take reasonable steps to prevent repeated or abusive Trial use.
7.3 Trial conversion and auto-renewal. Unless you cancel before the Trial ends, your Trial will automatically convert to a paid Pro subscription and you authorize us (via our payment processor) to charge the applicable subscription fee (plus any applicable taxes) at the end of the Trial. Thereafter, the subscription will renew automatically at the then-current rate for each billing period until canceled.
7.4 Prices, taxes, and billing. Prices, billing cycles, and included features are shown at checkout. Taxes may apply depending on your location and applicable law. We may update prices from time to time; if required, we will provide notice before changes take effect for your next renewal.
7.5 Cancellation. You can cancel at any time via your account settings (or by contacting us). Cancellation stops future renewals. If you cancel during the Trial, you will not be charged for Pro when the Trial ends. If you cancel after being charged, you will generally retain access to Pro features until the end of the then-current billing period unless stated otherwise.
7.6 Digital delivery. Access to Pro features is delivered digitally and typically becomes available immediately after successful payment (or during the Trial if enabled).
7.7 Refunds. Unless required by law or expressly stated at purchase, payments are non-refundable. Nothing in this section limits mandatory rights (for example, remedies for non-conformity/defects that cannot be excluded under consumer law).
7.8 EU/EEA/UK Consumers — right of withdrawal (digital services). If you are a Consumer in the EU/EEA/UK, you may normally have a 14-day right of withdrawal for online purchases. However, if Pro access is provided immediately (digital service), you may be asked at checkout to expressly consent to immediate performance and acknowledge that you lose the right of withdrawal once the service begins, to the extent permitted by law.
8) User Content
8.1 Your rights. You retain your rights in your User Content as between you and Pixefy.
8.2 License to operate the Service. You grant Pixefy a limited, worldwide, non-exclusive license to host, store, process, and transmit User Content only as needed to provide, maintain, and secure the Service and the features you choose to use. This license ends when the relevant content is deleted from Pixefy systems, subject to legal/operational retention described in the Privacy Policy.
8.3 Responsibility for User Content. You are responsible for your User Content and for ensuring you have all necessary rights to use and share it through the Service.

If there is a conflict between these Terms and the Privacy Policy regarding personal data, the Privacy Policy controls.
10) Intellectual property and feedback
10.1 Pixefy IP. The Service (software, design, features, logos, documentation) is owned by Pixefy or its licensors and protected by law. Except for the limited right to use the Service under these Terms, no rights are granted.
10.2 Feedback. If you provide feedback, you grant Pixefy a perpetual, irrevocable, worldwide, royalty-free right to use it without compensation.
11) Suspension and termination
11.1 By you. You may stop using the Service at any time.
11.2 By Pixefy. We may suspend or terminate your access if we reasonably believe you have violated these Terms, your use poses a security/legal risk, or we must do so to comply with law.
11.3 Effect. Upon termination, your rights to use the Service end. Sections that by their nature should survive termination (including IP, disclaimers, limitation of liability, indemnification, and governing law) will survive.
12) Disclaimers
The Service is provided “as is” and “as available.” To the maximum extent permitted by law, Pixefy disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that the Service will be uninterrupted, error-free, or fully secure.
13) Limitation of liability
To the maximum extent permitted by applicable law:a) Pixefy will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunities; andb) Pixefy’s total liability arising out of or related to the Service will not exceed the amount you paid to Pixefy for the Service in the 12 months preceding the event giving rise to the claim (or EUR 50 if you paid nothing).
Nothing in these Terms limits liability where it cannot be excluded under applicable law.
14) Indemnity (primarily for business users)
If you use the Service for business purposes (i.e., you are not a Consumer), you agree to indemnify and hold harmless Pixefy and its affiliates, officers, directors, employees, and agents from claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from:
- your User Content
- your use of the Service or
- your violation of these Terms or applicable law.
15) Changes
15.1 Service changes. Pixefy may modify or discontinue parts of the Service at any time.
15.2 Terms changes. Pixefy may update these Terms. If changes are material, Pixefy will provide notice (for example, via website notice or email). Continued use after the effective date means you accept the updated Terms.
16) Governing law and disputes
16.1 Governing law. These Terms are governed by the laws of Lithuania, excluding conflict of laws rules.
16.2 Courts. Unless mandatory Consumer laws provide otherwise, disputes will be subject to the exclusive jurisdiction of the competent courts in Lithuania.
17) Miscellaneous
17.1 Entire agreement. These Terms and the Privacy Policy form the entire agreement regarding the Service.
17.2 Severability. If any term is invalid or unenforceable, the remainder remains in effect.
17.3 Assignment. You may not assign these Terms without Pixefy’s consent. Pixefy may assign these Terms in connection with a merger, acquisition, or sale of assets.
17.4 No waiver. Failure to enforce a provision is not a waiver.
17.5 Export compliance. You agree to comply with applicable export controls and sanctions laws.
